Terms and Conditions of Sale

These Terms and Conditions of Sale ("Agreement") govern the purchase and sale of the Cylinder Lifter ("Product") offered by "Creative Media Tech Ltd" ("Seller") to customers ("Buyer"). By placing an order and making a purchase, Buyer agrees to be bound by these terms and conditions. Please read this Agreement carefully before making a purchase.

1. Ordering Process: Buyer may place an order for the Product through Seller's online platform. The order is subject to acceptance by Seller, and Seller reserves the right to refuse or cancel any order at its discretion.

2. Pricing: The prices for the Product are listed on Seller's website and are subject to change without prior notice. The Buyer is responsible for paying the price displayed at the time of purchase.

3. Payment: Payment for the Product must be made in full at the time of purchase. Seller accepts various payment methods as indicated on the website.

​1. Shipping: Seller will arrange for the shipment of the Product to the delivery address provided by Buyer. Shipping costs, if applicable, will be displayed during the checkout process and will be borne by the Buyer unless otherwise stated.

2. Delivery: Seller will make reasonable efforts to ensure timely delivery of the Product. However, Seller shall not be liable for any delays or non-delivery caused by circumstances beyond its control, including but not limited to acts of nature, transportation delays, or customs procedures.

3. Title and Risk of Loss: Title and risk of loss or damage to the Product pass to the Buyer upon delivery. It is the Buyer's responsibility to inspect the Product upon receipt and notify Seller of any visible damages or discrepancies within 3 days from the date of delivery.

1. Return Policy: If the Buyer is not satisfied with the Product, the Buyer may return it to Seller within 7 days from the date of delivery, provided the Product is in its original condition and packaging. To initiate a return, Buyer must contact Seller's customer support and follow the return instructions provided.

2. Return Shipping: The cost of return shipping shall be borne by the Buyer unless the return is due to an error on the part of Seller (e.g. incorrect item shipped or product defect).

3. Refunds: Upon receipt and inspection of the returned Product, Seller will process the refund within a reasonable time. The refund will be made using the original payment method used by the Buyer.

1. Warranty: The Product may be accompanied by a warranty, the terms of which will be provided by the manufacturer. Seller does not offer any additional warranties beyond those provided by the manufacturer unless expressly stated in writing.

2. Damages: In the event that the Product arrives damaged or defective, Buyer must notify Seller within 3 days from the date of delivery. Seller may request evidence of the damage, such as photographs or a detailed description. Seller will review the claim and, if deemed valid, may offer a replacement, repair, or refund at its discretion.

1. Import Duties and Taxes: For international orders, the Buyer is responsible for all applicable import duties, taxes, customs fees, and other charges imposed by the destination country. These charges are not included in the product price or shipping cost. The Buyer should contact their local customs office for more information on the applicable fees and regulations.

2. International Shipping: Seller will make reasonable efforts to arrange for international shipping of the Product. However, Seller cannot guarantee that the Product will comply with the import regulations or be available for shipment to all countries. The Buyer is responsible for verifying that the Product can be legally imported into the destination country.

3. Compliance with Local Laws: The Buyer is solely responsible for ensuring compliance with all local laws, regulations, and requirements related to the purchase, importation, use, and resale of the Product in their country.

4. Limitation of Liability for International Shipments: Seller shall not be liable for any delays, non-delivery, loss, damage, or additional fees incurred during international shipping, including but not limited to customs inspections, clearance procedures, or transportation issues. Any claims or disputes arising from international shipments shall be governed by the relevant international trade laws and regulations.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SELLER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE PRODUCT, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

2. SELLER'S TOTAL LIABILITY TO BUYER FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE PRODUCT SHALL NOT EXCEED THE AMOUNT PAID BY BUYER FOR THE PRODUCT GIVING RISE TO THE CLAIM.

​1. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.

2. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

1. Entire Agreement: This Agreement constitutes the entire agreement between Seller and Buyer regarding the sale of the Product and supersedes any prior or contemporaneous agreements, communications, or understandings, whether oral or written.

2. Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

3. Waiver: The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of its right to do so in the future.

By making a purchase, Buyer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions of Sale.
